1. Introduction

Welcome to Ishema (“Ishema,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of Ishema’s website, mobile application, and all related products and services (collectively, the “Services”).

Ishema is a digital employment platform designed to connect job seekers, employers, recruiters, and organizations in a trusted and professional environment.

By creating an account, accessing, or using our Services, you agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not access or use the Services.

2. Eligibility

To use Ishema, you must:

Be at least 18 years of age;
Have the legal capacity to enter into a binding agreement under applicable law;
Provide accurate and truthful information during registration;
Not be prohibited by law from using our Services.

If you are using Ishema on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Ishema reserves the right to suspend or terminate accounts that do not meet these eligibility requirements.

3. Your Account

To access certain features of Ishema, you must create an account. You agree to:

Provide complete, accurate, and current information during registration.
Keep your account information updated.
Maintain the confidentiality of your password and login credentials.
Notify Ishema immediately if you believe your account has been accessed without your authorization.

You are responsible for all activities that occur under your account unless the unauthorized activity results from our failure to protect your account.

You may not:

Share your account with another person.
Sell, transfer, or rent your account.
Create multiple accounts to evade restrictions or manipulate platform features.
Use another person’s account.

Employers may be required to complete additional verification before accessing certain recruitment features.

4. Using Ishema

Ishema provides a digital platform that enables users to:

Create professional profiles;
Search and apply for employment opportunities;
Post and manage job vacancies;
Communicate with other users;
Participate in career-related communities and events; and
Access additional employment-related services introduced by Ishema.

Ishema acts solely as a technology platform that facilitates connections between users. Unless expressly stated otherwise, Ishema is not: an employer; an employment agency; a recruitment agency; a labor broker; a staffing company; or a party to any employment relationship created through the Services.

Employment decisions are made solely by employers and applicants.

Ishema does not guarantee: employment; interviews; job offers; successful recruitment; employer legitimacy beyond any verification we may conduct; or the accuracy of information provided by users.

Users are responsible for exercising appropriate judgment and due diligence before entering into employment or business relationships.

5. User Responsibilities

To help maintain a safe, respectful, and professional platform, all users agree to:

Provide truthful and accurate information.
Keep profile information reasonably up to date.
Respect the rights and dignity of other users.
Use the Services only for lawful purposes.
Protect the confidentiality of their account credentials.
Comply with applicable laws and regulations.

Users are responsible for all content they upload, publish, or share through Ishema. You must not submit information that you know is false, misleading, fraudulent, defamatory, or otherwise unlawful.

6. Employer Responsibilities

Employers and recruiters play an important role in maintaining trust on the platform. By using Ishema as an employer, you agree to:

Post only genuine employment opportunities.
Represent your organization honestly and accurately.
Provide truthful information about job duties, qualifications, compensation, and working conditions.
Treat applicants fairly and professionally.
Respect the privacy of candidate information.
Use applicant information only for legitimate recruitment purposes.

Employers must not:

Charge applicants application fees, interview fees, placement fees, or any other recruitment-related payment unless expressly permitted by applicable law.
Request unnecessary personal or financial information unrelated to recruitment.
Misrepresent job opportunities.
Collect resumes or personal information for unauthorized purposes.
Use Ishema to advertise illegal, deceptive, or fraudulent opportunities.

Ishema reserves the right to verify employer information and remove job postings that violate these Terms.

7. Fraud Prevention and Prohibited Conduct

Maintaining a trusted employment marketplace is one of Ishema’s highest priorities. You must not use the Services to engage in any fraudulent, deceptive, abusive, or unlawful activity. Prohibited conduct includes, but is not limited to:

Creating fake accounts or impersonating another individual or organization.
Posting false or misleading job opportunities.
Misrepresenting your qualifications, identity, or authority.
Using forged or altered documents.
Requesting money, deposits, gifts, or financial information from applicants in exchange for employment opportunities.
Conducting scams, phishing, pyramid schemes, money laundering, or other illegal activities.
Harvesting resumes or personal information for unauthorized purposes.
Collecting user information without consent.
Sending spam or unsolicited commercial messages.
Harassing, threatening, intimidating, or abusing other users.
Publishing discriminatory, hateful, or unlawful content.
Uploading malicious software, viruses, or harmful code.
Circumventing Ishema’s security measures.
Scraping, copying, or extracting data from the platform through automated means without our written permission.
Attempting to interfere with the proper operation of the Services.

If Ishema reasonably believes that a user has engaged in prohibited conduct, we may investigate and take appropriate action, including removing content, restricting access, suspending or terminating accounts, and cooperating with competent authorities where required or permitted by law.

We encourage users to report suspected fraud or misuse through the reporting tools provided on the platform or by contacting our support team.

8. User Content

You retain ownership of the content you create, upload, or submit through Ishema, including your profile information, curriculum vitae (CV), resumes, cover letters, portfolios, job postings, company information, messages, comments, images, and other materials (“User Content”).

By submitting User Content through the Services, you grant Ishema a non-exclusive, worldwide, royalty-free, revocable license to host, store, reproduce, display, transmit, and process your User Content solely for the purpose of operating, maintaining, improving, and providing the Services.

This license ends when your content is permanently deleted from our systems, except where we are required to retain certain information to comply with legal obligations, resolve disputes, enforce these Terms, or maintain platform security.

You represent and warrant that:

You own or have the necessary rights to upload and share the content.
Your content does not violate the rights of any third party.
Your content complies with applicable laws and these Terms.
Your content is accurate to the best of your knowledge.

Ishema reserves the right, but is not obligated, to review, remove, restrict, or refuse User Content that violates these Terms or applicable law.

9. Intellectual Property

The Ishema platform, including its name, logo, trademarks, software, designs, text, graphics, databases, features, and other proprietary materials, are owned by or licensed to Ishema and are protected under applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

Copy, reproduce, distribute, modify, or create derivative works from any part of the Services.
Reverse engineer, decompile, or attempt to extract the source code of the platform.
Remove copyright, trademark, or proprietary notices.
Use the Ishema name, logo, or branding without prior written permission.

Nothing in these Terms transfers ownership of Ishema’s intellectual property to users.

10. Suspension and Termination

Suspension by Ishema

Ishema may suspend, restrict, or terminate access to all or part of the Services if we reasonably believe that a user has violated these Terms; provided false or misleading information; engaged in fraudulent or unlawful activity; compromised the security of the platform or other users; or repeatedly violated community standards or platform policies.

Where appropriate and reasonably practicable, we will notify you of the reason for the suspension and provide an opportunity to respond or correct the issue.

Account Termination by Users

You may close your account at any time through your account settings or by contacting Ishema Support. Termination of your account does not automatically delete all information where retention is required by law or reasonably necessary to comply with legal obligations, resolve disputes, investigate fraud, enforce these Terms, or maintain the security and integrity of the Services.

11. Disclaimers and Limitation of Liability

Service Availability

We strive to provide reliable and uninterrupted Services. However, we do not guarantee that the Services will always be available, uninterrupted, secure, or free from errors. The Services may occasionally be unavailable due to maintenance, technical issues, security incidents, or circumstances beyond our reasonable control.

Employment Disclaimer

Ishema is a technology platform that facilitates connections between employers and job seekers. We do not guarantee employment, interviews, job offers, the authenticity of every employer or applicant, the quality or accuracy of user-generated content, or participation in employment contracts or decisions. Users remain responsible for exercising reasonable judgment when interacting with other users.

Limitation of Liability

To the fullest extent permitted by applicable law, Ishema shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of the Services. Where permitted by law, Ishema’s total liability for any claim arising from these Terms or the Services shall not exceed the amount you have paid to Ishema, if any, during the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

12. Governing Law, Dispute Resolution, and Changes to These Terms

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Rwanda, without regard to conflict of law principles. We encourage users to contact us first to resolve any concerns or disputes informally and in good faith. If a dispute cannot be resolved through discussion, it shall be submitted to the competent courts of the Republic of Rwanda, unless applicable law provides otherwise.

Changes to These Terms

As Ishema continues to grow, we may update these Terms from time to time. Where changes are material, we will provide reasonable notice through the Services, by email, or through other appropriate means before the updated Terms become effective. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you should discontinue your use of the Services and may close your account.
